New York is one of the only states to exclude families from making
critical medical decisions for patients who lack the capacity to decide
for themselves. Tragically, this fact is often not discovered until it is
too late. As a result, incapacitated patients with no Health Care Proxy
are subject to medical decisions made by those with far less knowledge of

The Assembly version of the FHCDA,
A.7729 was passed on January 20, 2010.
The Senate version,
S.3164 is moving through committees and will hopefully be voted on by
the full Senate soon.
